29 CFR 1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head. On or April 9, 2024, employees were performing residential construction activities at heights exceeding six (6) feet and were wearing harnesses where the attachment point of the harness was not located in the center of the wearer's back, exposing the employees to a fall hazard of approximately 21.2-30 feet. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about April 9, 2024 the employer did not have a training program and employees were not adequately trained in the recognition of jobsite hazards, including but not limited to, fall hazards and proper use of harnesses. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
