29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. On April 4, 2024, and at times prior thereto, employees at the jobsite and when operating scissor lifts or during any operation of Mobile Elevating Work Platform- MEWP equipment, were not trained to operate or understand how to recognize and avoid/eliminate unsafe conditions.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On or about April 4, 2024, on the south side of the jobsite; employee(s) elevated in a scissor lift (Mobile Elevating Work Platforms- MEWP) without adequate fall protection were performing spray insulation work and not protected from fall hazards.
