29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about April 15, 2024, employees working in a 7.4 foot deep excavation were exposed to struck-by hazard(s) from soil spoil pile located directly above the top edge of the excavation on both the North and West sides. The employer did not ensure the spoil pile was properly retained or kept at least two (2) feet from the edge to prevent those materials from falling or rolling into the excavation.
