29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) 221 South 4th Street, Hamburg, PA - Company Wide - On or about April 15, 2024, employee use chemicals including, but not limited to, lubricants, solvents, and products containing respirable crystalline silica. The employer did not have a written hazard communication program. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.95(k)(3): The employer did not ensure that each employee exposed to noise at or above an 8-hour time weighted average of 85 decibels was trained and informed of the information included in sections k(3)(i) through k(3)(iii). (a) 221 South 4th Street, Hamburg, PA; molding department - On or about April 15, 2024, employees were exposed to noise levels in excess of the action level and did not have hearing conservation training. (b) 221 South 4th Street, Hamburg, PA; grinding department - On or about April 15, 2024, employees were exposed to noise levels in excess of the permissible exposure limit (PEL) and did not have hearing conservation training. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
