29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  a. On or about April 8, 2024, the employer did not ensure that a Buffalo Tools Pro-Series (Model no. TOWERINT3; Item no. 2603653) multi-use baker-style scaffold was erected and used under the supervision and direction of a competent person.  An employee that was not experienced and trained for such work to the level of a competent person assembled and used the scaffold failing to utilize parts of the scaffold that include but were not limited to guardrails which exposed the employee to a fall hazard of approximately 20 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  a. On or about April 8, 2024, an employee was on the top platform of a Buffalo Tools Pro-Series (Model no. TOWERINT3; Item no. 2603653) multi-use baker-style scaffold at heights of approximately 20 feet without guardrails installed or any other means of fall protection/prevention in use. As a result, the employee was exposed to a fall hazard of approximately 20 feet.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a. On or about April 8, 2024, the employer did not ensure that employees performing work from the Buffalo Tools Pro-Series (Model no. TOWERINT3; Item no. 2603653) multi-use baker-style scaffold were provided sufficient training on information such as, but not limited to, fall hazards, the proper use of the scaffold, the correct procedure for erecting the fall protection systems and ways to minimize the hazards associated with scaffold usage. As a result, an employee was exposed to a fall hazard of up to approximately 20 feet.

The training shall include the following topics, as applicable:  a. On or about April 8, 2024, an employee was directed to erect a Buffalo Tools Pro-Series (Model no. TOWERINT3; Item no. 2603653) multi-use baker-style scaffold that was not provided with competent person level training prior. As a result, an unsafe scaffold was erected and utilized, exposing the employee to a fall hazard of up to approximately 20 feet.
