29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  Instance A) On or about April 15, 2024, at the intersection of Main St. and Monroe St. Sylvania OH 43560 the employer Mosser Construction Inc., failed to implement engineering controls, work practices and respiratory protection specified for the task in Table 1.  Employees using a Stihl brand handheld power saw (model TS420 - S/N: 191638940) equipped with no dust collection vacuum system and no water delivery system as specified in Table 1, were exposed to respiratory hazards including respirable crystalline silica.  Instance B) On or about April 15, 2024, at the intersection of Main St. and Monroe St. Sylvania OH 43560 the employer Mosser Construction Inc., failed to implement engineering controls, work practices and respiratory protection specified for the task in Table 1.  Employees using a BB40 US HEX jackhammer (model MAC3MF03T16 - S/N: 1539015) equipped with no dust collection vacuum system and no water delivery system as specified in Table 1, were exposed to respiratory hazards including respirable crystalline silica.
