29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) 166 South New Holland Road, Kinzers, PA; on the roof at the east facing lower end - On or about April 16, 2024, employees were not protected from a fall hazard of approximately 10 feet to a lower level while placing steel panels at the roof edge. (b) 166 South New Holland Road, Kinzers, PA; on the roof at the west facing higher end - On or about April 16, 2024, employees were not protected from a fall hazard of approximately 40 feet to the ground level while placing steel panels at the roof edge. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. (a) 166 South New Holland Road, Kinzers, PA - On or about April 16, 2024, employees were conducting roofing activities at heights of approximately 10 feet and approximately 40 feet above the lower level without having been certified as having received training to recognize the hazards of falling and procedures to be followed in order to minimize these hazards. No abatement required - corrected during inspection.
