29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Angelo's Marble and Granite Inc. located at or near 2500 Ellsworth Street, Philadelphia, PA 19146 - The employer did not administer a continuing effective hearing conservation program for employees engaged in stone cutting and finishing activities and exposed to continuous noise levels equivalent to 134.6%, 139%, and 97.4% of the allowable 50% dose for an 8 hour time-weighted average (TWA). These exposures were equivalent to an 8 hour TWA of 92.1 dBA, 92.3 dBA, and 89.8 dBA respectively, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. Sampling times were 345, 347, and 342 minutes, respectively. Zero exposures were assumed for all unsampled time periods. Violation noted on July 24, 2024.

Employees engaged in the cutting, routing, and polishing of natural and engineered stone were exposed to crystalline silica dust. Employees were overexposed to respirable crystalline silica while engaged in stone cutting and finishing activities. Employees were exposed to respirable crystalline silica during an 8-hour workday of 43.484 micrograms per cubic meter (?g/m3) and 37.015 (?g/m3) for an 8-hour Time Weighted Average (TWA), which is 1.7393 and 1.4806 times the OSHA Action Level of 25 micrograms per cubic meter, respectively.
