OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by hazard. Location: a) Outside of 270 14th Street, BROOKLYN, NY 11215: On or about April 16, 2024, employees were in the process of loading a pile driver machine onto a flatbed truck when the machine tipped over and struck a building. During this operation, the employer failed to prevent the tipping over by setting up the machine in the correct configuration, thereby exposing employees to struck-by hazard. The employer did not have a competent person acting as a spotter to make constant observations to ensure safe movement of the equipment.
