29 CFR 1904.41(a)(1): Annual electronic submission of part 1904 records by establishments with 250 or more employees. The establishment had 250 or more employees at some time during the previous calendar year, and this part required the establishment to keep records, but the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:   a) Sunbelt Pool Products, LLC:  On or about April 17, 2024, the employer failed to electronically submit information from their OSHA Form 300A, Summary of Work-Related Injuries and Illnesses or equivalent form, for calendar year 2023 on or before March 2, 2024.  The establishment employed 400 employees during calendar year 2023 and was classified under NAICS code 236220.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years.  a).  Throughout the warehouse: On or about April 17, 2024, employees were exposed to fall and ejection/crushing hazards, in that the employer allowed employees to operate powered industrial trucks, such as, but not limited to, forklifts and pallet jacks without completing re- training and a practical evaluation prior to operating the Yale Forklift.
