29 CFR 1926.652(a)(1)(ii): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph 29 CFR 1926.652(b) or 29 CFR 1926.652(c) of this section except when: excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.    At a worksite located at 10715 Holmes Road, Kansas City, MO 64131:   Employees were exposed to struck-by and crushing hazards. This was demonstrated on April 17, 2024, when employees were working in an unprotected excavation greater than 5 feet in depth. Employees were working to install fiber optic lines near a residential home and were not provided with any benching, sloping, or other engineered protective systems.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  At a worksite located at 10715 Holmes Road, Kansas City, MO 64131:   Employees were exposed to struck-by and crushing hazards. This was demonstrated on April 17, 2024, when employees worked in an unprotected excavation where there was no safe means of egress provided in the excavation. Employees were working to install fiber optic lines and were not provided with a ladder, ramp, stairway or other safe means of egress in an excavation that was greater than 4 feet in depth.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  At a worksite located at 10715 Holmes Road, Kansas City, MO 64131:   Employees were exposed to struck-by and crushing hazards. This was demonstrated on April 17, 2024, when employees worked in an unprotected excavation where excavated materials were placed at least 2 feet or less from the edge of the excavation. Employees were working to install fiber optic lines and were not provided with protection from falling materials by placing the material at another location or further than 2 feet from the excavation edge.
