OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  On or about April 12, 2024, employees were exposed to vehicle struck-by hazards in the vehicle wash bay located at 87848 430th Avenue in Ainsworth, Nebraska.  The employer exposed employees to a recognized struck-by hazard created by failing to ensure vehicles parked in the vehicle wash bay for cleaning were secured from inadvertently rolling.  The employer has the feed truck operators wash their over-the-road vehicles daily in a 150ft long by 50ft wide, downward facing wash bay.  The wash bay slopes downward toward a drain grate at a 4-degree angle.  Washing the vehicles requires the employees to stand in front and downslope of the vehicle during washing and when cleaning the wash bay after.  An employee suffered a compound fracture of their right leg when the vehicle they were washing rolled downslope and struck them as they cleaned the wash bay.     AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS INCLUDE BUT ARE NOT LIMITED TO:  i.	Follow the instructions in the Peterbilt Operator's Manual that include, but are not limited to:  a.	Page 171 - Block wheels when parked on a steep grade. b.	Page 174 - Set the parking brake and block the wheels when performing maintenance.  c.	Page 217 - Test the vehicle brakes after each vehicle wash. ii.	Develop, implement, and communicate to employees a written work rule that address the steps that must occur before starting and finishing sanitation operations in the wash bay, including setting the brakes on the vehicle and chocking the wheels.    iii.	Park the feed truck at the bottom of the wash bay and perform sanitation operations there. iv.	Install physical barriers such as a parking stop to rest the front wheels of the trucks against during cleaning operations that meet the Peterbilt Operator's manual guidelines found on page 162 of 4in tall by 4in wide.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On or about April 15, 2024 the employer failed to report a work related hospitalization within 24 hours.  On April 12, 2024, an employee was washing a feed truck in the wash bay, when the feed truck ran over the employee.  The employee was taken to the hospital to receive treatment.  The employer reported this to OSHA on April 15, 2024.

29 CFR  1904.41(a)(2): The employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illness to OSHA or OSHA's designee when their establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and their establishment was classified in an industry listed in appendix A to subpart E of this part:  The employer failed to submit OSHA 300A summary report within the required time frame for fiscal year 2023. This was most recently documented on or about April 15th, 2024.
