29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task in Table 1:  a)  On or about April 17, 2024, and at times prior, the controlling employer, Asset Engineering Limited dba Asset Construction Management, did not ensure that all requirements in Table 1 were implemented to protect its subcontracted employees of 970 Excavation, Inc., from exposure to respirable crystalline silica dust during indoor concrete fracturing operations using a non-enclosed cab Bobcat MT100 utility vehicle equipped with a jackhammer attachment.  This condition exposed subcontracted employees to respiratory hazards due to crystalline silica dust.  b) On or about April 17, 2024, and at times prior, the controlling and exposing employer, Asset Engineering Limited dba Asset Construction Management, did not ensure that all requirements in Table 1 were implemented to protect its employees from exposure to respirable crystalline silica dust during indoor concrete cutting operations using a water-fed Husqvarna K3000 Concrete Saw.  Employees did not use respiratory protection with an assigned protection factor (APF) of 10, as required.  This condition exposed employees to respiratory hazards due to crystalline silica dust.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:   a)  On or about April 17, 2024, and at times prior, the controlling and exposing employer, Asset Engineering Limited dba Asset Construction Management, did not ensure its employees or subcontracted employees of 970 Excavation, Inc., had been assessed for exposure to respirable crystalline silica dust at or above the action level when required to engage in indoor concrete  cutting and fracturing operations.  Subcontracted employees used a non-enclosed cab Bobcat MT100 equipped with a jackhammer attachment to fracture concrete and were also required to work outside of the cab in close proximity to this operation.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan for exposure to respirable crystalline silica dust:   a)  On or about April 17, 2024, and at times prior, the controlling and exposing employer, Asset Engineering Limited dba Asset Construction Management, did not implement a written exposure control plan to protect its employees and subcontracted employees of 970 Excavation, Inc., from exposure to respirable crystalline silica dust when engaged in indoor concrete cutting and fracturing.  Subcontracted employees used a non-enclosed cab Bobcat MT100 equipped with a jackhammer attachment and were also required to work in close proximity to this operation.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that employees covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica:   a)  On or about April 17, 2024, and at times prior,  Asset Engineering Limited dba Asset Construction Management, did not ensure its employees who were exposed to respirable crystalline silica dust during indoor cutting and concrete fracturing operations, could demonstrate the knowledge and understanding of respirable crystalline silica dust exposure including, but not limited to:  health hazards, means of generation, and necessary control measures.
