29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) In the pipe plant, north end, a mixer operator was exposed to noise levels at 167.4% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 167.4% is approximately 92.5 dBA.  Sampling was performed for 561 minutes during one shift on May 7, 2024.  (b) In the pipe plant, north end, a production helper was exposed to noise levels at 124.5% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 124.5% is approximately 91.5 dBA.  Sampling was performed for 558 minutes during one shift on May 7, 2024.  (c) In the pipe plant, south end, a mixer operator was exposed to noise levels at 124.4% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 124.4% is approximately 91.5 dBA.  Sampling was performed for 561 minutes during one shift on May 7, 2024.  (d) In the pipe plant, south end, a production helper was exposed to noise levels at 225.9% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 225.9% is approximately 95.8 dBA.  Sampling was performed for 602 minutes during one shift on May 7, 2024.

29 CFR  1904.41(a)(2): The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.  The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  (a) Del Zotto Products of Texas, Inc., 5701 State Highway 135, Gladewater, Texas 75647: On or about April 18, 2024, the employer did not electronically submit information from their 2023 OSHA Form 300A or equivalent by March 2, 2024.  The establishment had 116 employees and was classified in NAICS 327332 during calendar year 2023.
