29 CFR 1926.1153(d)(3)(i): The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible: On or about October 31, 2023, the employer did not use the required engineering and work practice controls such as an integrated water delivery system that would continuously feed water to the blade that to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL while using a Gorilla Concrete Tools (GCT-X Series) "crack chaser." Employees were observed indoors using a walk-behind saw affixed with a 10" blade that was able to cut up to 3" deep into the concrete floor so that the cracks were widened for a filler sealant that was subsequently applied in the cracks.

29 CFR 1926.1153(g)(1)(iv): The exposure control plan did not contain a description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors: the employer's exposure control plan did not contain a description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure when employees used a Gorilla Concrete Tools (GCT-X Series) that generated concrete dust while chasing cracks created in the floor. The plan also did not include detail on restricting access for the exposures generated by other employers or sole proprietors.
