1926.503(c)(3) The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. Roof - On or about April 22, 2024, employees removed siding from the second-floor exterior, standing on the previously cleared roof over the entry. 29 CFR 1926.850(a): Evidence in writing was not available that an engineering survey performed by a competent person had been performed prior to permitting employee(s) to start demolition operations: a. 5259 Spring Road Shermans Dale, PA - On or about April 22, 2024, employees were performing work on a building being partially demolished (Gutrehab), the employer had not conducted and documented in writing that an engineering survey had been performed by a competent person to address prior to the start of demolition work. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
