On or about April 22, 2024, at 2130 W Russet Court #10 in Appleton, Wisconsin, employees who were not wearing hard hats were exposed to potential struck-by hazards while working below a roof eave edge with power tools, roofing materials, and handheld tools used on the roof during the installation of roofing materials.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about April 22, 2024, at 2130 W Russet Court #10 in Appleton, Wisconsin, employees were exposed to a fall hazard working on a roof 16 feet above surface level without using required fall protection equipment. Hector Hernandez Morales dba Hernandez Roofing was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13) which was contained in OSHA inspection number 1607354, citation number 02, item number 01a and was affirmed as a final order on February 27, 2023, with respect to a workplace located at 2279 Henry St., Neenah, WI 54956. Hector Hernandez Morales dba Hernandez Roofing was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13) which was contained in OSHA inspection number 1475961, citation number 01, item number 002 and was affirmed as a final order on July 14, 2020, with respect to a workplace located at 624 Kessler Dr., Neenah, WI 54956.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about April 22, 2024, at 2130 W Russet Court #10 in Appleton, Wisconsin, the employer did not provide required fall protection safety training for employees working at heights greater than six feet. Employees were installing roofing materials on a two-story building with unprotected roof edges. Hector Hernandez Morales dba Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(2) which was contained in OSHA inspection number 1607354, citation number 02, item number 01b and was affirmed as a final order on February 27, 2023, with respect to a workplace located at 2279 Henry St., Neenah, WI 54956.
