29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: At the unloading sand area, employees were exposed to noise related hazards. An effective hearing conservation program which included noise monitoring and audiometric testing of employees as detailed in the standard was not instituted by the employer. a) On or about April 29, 2024, employee #1 was engaged in unloading activities, was exposed to continuous noise levels of 97.6 dBA in a 8-hour time-weighted average sound level. Employee was exposed 3 times the permissible exposure limit. b) On or about April 29, 2024, employee #2 was engaged in unloading activities, was exposed to continuous noise levels of 95.5 dBA of the 8-hour time-weighted average sound level. Employee was exposed 2 times the permissible exposure limit. c) On or about April 29, 2024, employee #3 was engaged in unloading activities, was exposed to continuous noise levels of 99.6 dBA in a 8-hour time-weighted average sound level. Employee was exposed 4 times the permissible exposure limit.
