29 CFR 1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall: 29 CFR 1926.502(d)(16)(iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level; a. Located at the job site at 201 Wyman Lake Drive, Delaware, Ohio 43015: On or about April 24, 2024, the employer did not ensure that the personal fall arrest system components, such as the full body harnesses, were properly rigged in that the harness did not fit and was too loose, therefore allowing the employee to contact the lower level. As a result, an employee was exposed to a fall hazard of approximately 18 feet.

The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head. a. Located at the job site at 201 Wyman Lake Drive, Delaware, Ohio 43015: On or about April 24, 2024, the employer did not ensure that the full body harness fit properly in that it was too loose, resulting in the attachment point not being in the center of the wearer's back near shoulder level. As a result, employees were exposed to serious injuries in the event of a fall.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings shall be provided with guardrail systems. Guardrail system criteria are contained in subpart M of this part. a. Located at the job site at 201 Wyman Lake Drive, Delaware, Ohio 43015: On or about April 24, 2024, the employer did not ensure that the unprotected sides of the stairway landing that employees utilized to access the second story to perform framing work had guardrails in place. As a result, employees were exposed to a fall hazard of approximately 14 feet to the ground below.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. Located at the job site at 201 Wyman Lake Drive, Delaware, Ohio 43015: On or about April 24, 2024, the employer did not ensure that the portable ladder utilized for accessing the roof was extended at least 3 feet beyond the surface being accessed and/or secured at its top to a rigid support and that a grasping device was utilized. As a result, employees were exposed to a fall hazard of approximately 18 feet to the ground below.
