Rudy Roofing LLC dba Rudy Rivera Membreno located at 4730 E Dublin Granville Rd, Westerville, OH 43081: On or about April 24, 2024,  the employer did not initiate and maintain accident prevention programs that included work rules, training, inspections and enforcement at an institutional construction site where employees were exposed to multiple fall and struck-by hazards. Employees were performing work on the roof of an institutional building at heights of between 12 and over 30 feet without fall protection, using an improperly configured ladder, using an improperly configured scaffold and utilizing a rough-terrain forklift without compliant operator qualifications/certifications

Rudy Roofing LLC dba Rudy Rivera Membreno located at 4730 E Dublin Granville Rd, Westerville, OH 43081: On or about April 24, 2024,  the employer did not ensure that a scaffold platform being utilized to lift personnel using a Genie GTH-844 telehandler rough terrain forklift was designed by a qualified person. Two employees were exposed to a fall of over 12 feet when using a work platform (plywood sheet) without guardrails or any other form of fall protection while performing  roofing activities as a part of an industrial/governmental construction project.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.   a. Rudy Roofing LLC dba Rudy Rivera Membreno located at 4730 E Dublin Granville Rd, Westerville, OH 43081: On or about April 24, 2024, the employer permitted employees to work off a work platform (plywood sheet) that was elevated on the forks by a Genie GTH-844 telehandler rough terrain forklift, that was not approved by the manufacturer to lift personnel. By permitting the employee to work off the platform, the employer exposed the employees to a fall hazards of over 12 feet to the ground level.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. 29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Rudy Roofing LLC dba Rudy Rivera Membreno located at 4730 E Dublin Granville Rd, Westerville, OH 43081: On or about April 24, 2024, the employer did not ensure that portable ladders used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access and/or were secured at the top with a grasping device. One extension ladder was used to gain access to roof and was was positioned approximately 12 inches below landing surface and was not secured in any way which exposed employees to falls over 18 feet.

Rudy Roofing LLC dba Rudy Rivera Membreno located at 4730 E Dublin Granville Rd, Westerville, OH 43081 : On or about April 24, 2024, the employer did not ensure that the area around the bottom of a portable ladder used to gain access was kept clear. One extension ladder was used to gain access to roof and was was positioned with a pile of old shingles around the base which exposed employees to slips/falls when mounting/dismounting the ladder.
