29 CFR 1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) Gemini Trucking & Pallet LLC located at 13600 County Road 27, Fayette, Ohio, 43521: On or about May 2, 2024, the employer failed to ensure that each employee tasked with operation powered industrial vehicles such as, but not limited to, the Hyster (model 50CT2) forklift were adequately trained through a combination of formal instruction, practical training and evaluation prior to operating the vehicles. Powered industrial vehicle operators and pedestrians were exposed to potential struck-by and crushing hazards in that employees operated the vehicles without the benefit of training.

The employer or employer representative failed to contact the Toledo Area Office or the 24 hour OSHA number to notify the agency of an employee's amputation injuries within 24 hours of the incident.
