29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer were exceeded: On or about April 27, 2024, at 1231 Dickerson Drive, Coral Gables, Florida, an employee was exposed to 26- to 29-foot fall, tip over and struck-by hazards when operating an aerial lift at an approximated 22-degree boom angle with respect to the horizontal plane without extending the equipment's axels.

29 CFR 1926.454(c)(2): The employer failed to retrain employees where changes in the types of scaffolds, fall protection, falling object protection, or other equipment presented a hazard about which they had not been previously trained: On or about April 27, 2024, at 1231 Dickerson Drive, Coral Gables, Florida, the employer did not ensure an employee preforming painting work from an aerial lift was retrained to recognize and avoid the hazards associated with the operation of the type of equipment being used, thus exposing the employee to 26- to 29-foot fall, tip over and struck-by hazards.
