OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to struck-by and crushing hazards of tipping storage rack systems. (a) On or about April 29, 2024, the employer did not ensure that the storage racks, located in Warehouse cooler #1, were anchored or otherwise bolted to the floor, exposing employees that interact with the racking system to struck-by and crushing hazards. (b) On or about April 29, 2024, the employer did not ensure that the storage racks, located in Warehouse cooler #2, were anchored or otherwise bolted to the floor, exposing employees that interact with the racking system to struck-by and crushing hazards. (c) On or about April 29, 2024, the employer did not ensure that the storage racks, located in Warehouse cooler #3, were anchored or otherwise bolted to the floor, exposing employees that interact with the racking system to struck-by and crushing hazards.

On or about April 29, 2024, the employer did not ensure the access to the Cooler 3 exit door located in the northwest corner of the warehouse was at least 28 inches wide. Material stored in front of the exit door limited the size of the access to approximately less than 24 inches, exposing employee(s) to evacuation hazards created from palletized goods blocking the exit.
