29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a)  1024 Sparrow Way, Breinigsville, Pa, Units 1016 and 1024 - On or about April 30, 2024, employees were utilizing pneumatic nail guns which cause flying wood chips, dust and particles.  The employer did not ensure employees utilized eye protection.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  1024 Sparrow Way, Unit #1024, Breinigsville, Pa - On or about April 30, 2024, employees worked from a 8/12 pitched roof approximately 30' above grade to perform shingle replacement, but the employees were not utilizing any means of fall protection.  b)  1016 Sparrow Way, Unit #1016, Breinigsville, Pa - On or about April 30, 2024, employees worked from a 8/12 pitched roof approximately 30' above grade to perform shingle replacement, but the employees were not utilizing any means of fall protection.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a)  1024 Sparrow Way, Breinigsville, Pa - On or about April 30, 2024, employees utilize an extension ladder to gain roof access approximately 30' above grade.  The ladder was not secured at its top to prevent deflection.
