OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazard of patient on staff violence including being physically assaulted by patients utilizing weapons:  On or about April 24, 2024, and at times continuing thereafter, the employer failed to ensure that healthcare providers were protected against life-threatening injuries from patient-on-staff violence including, but not limited to, patients harboring and/or utilizing weapons. During a mental health appointment, a caretaker was assaulted by a patient and stabbed multiple times with a knife that was brought into the facility without detection. The assault resulted in the inpatient hospitalization of the employee with face and upper body wounds.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:   On or about April 30, the employer did not report a workplace injury that resulted in an in-patient hospitalization of an employee following a workplace violence incident that occurred on April 24, 2024, at approximately 1:15 PM.
