29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Vilaltas Construction LLC , failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 2 a serious violation of 29 CFR 1926.503(c)(3) with an abatement date of August 12, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about April 30, 2024, at a jobsite located at N165 W20522 Berry Patch Rd, Jackson, WI 53037, employees installing a new roof on an approximately 11:12 pitch roof were not wearing fall protection. This exposed employees to a fall hazard of approximately 21 feet from roof to the ground below.

29 CFR  1926.503(c)(3): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section.  (a) On or about April 30, 2024, at a jobsite located at N165 W20522 Berry Patch Rd, Jackson, WI 53037, the employer did not retrain employees that were not utilizing fall protection and were not utilizing fall protection properly while installing a roof on an existing residential property with an approximately 11:12 pitch roof. This exposed employees to a fall hazard of approximately 21feet from roof to the ground below.
