29 CFR 1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. Instance A) On or about May 1st, 2024, at 201 N Summit Street Toledo, Ohio 43604 DMG Contractors Inc., failed to implement engineering controls, work practices and respiratory protection specified for the task in Table 1. , Employees were exposed to respiratory hazards including respirable crystalline silica while using a Stihl brand handheld power saw with no dust collection vacuum system and no water delivery system as specified in Table 1.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section. On or about May 1st, 2024, at 201 N Summit St Toledo, Ohio 43604 the employer DMG Contractors Inc., failed to ensure that each employee at the jobsite was adequately trained in the information covered by this section ensuring employees could demonstrate knowledge and understanding of the specific job tasks resulting in exposure to respirable crystalline silica resulting in the health hazards including but not limited to silicosis.
