29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a) Zarate's Roofing LLC, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:    Citation 1, Item 1, a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of July 17, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Zarate's Roofing LLC, failed to provide documentation to the Agency demonstrating that abatement is completed within 10 days after the abatement date for each of the following cited violations that were issued by the Agency  Citation 3, Item 1, an other-than-serious violation of 29 CFR1926.503(b)(1) with an abatement date of July 17, 2024.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about May 1, 2024, located at 516 Cambridge Avenue, Waukesha, WI 53188, the employer failed to ensure all employees performing tear off operations on 4:12 pitch one-story residential home roof, were protected by guardrails, safety net systems, or personal fall arrest system, exposing employees to a fall hazard of approximately eight and a half feet (8.5 feet) to the ground below.  Zarate's Roofing LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1635860, citation number 1, item number 2 and was affirmed as a final order on January 8, 2024, with respect to a workplace located at 355 West Wisconsin Avenue, Oconomowoc, WI 53066.  Zarate's Roofing LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1643278, citation number 1, item number 1 and was affirmed as a final order on January 8, 2024, with respect to a workplace located at 646 South State Street, Oconomowoc, WI 53066.
