29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1: a.) Massaro Corporation, worksite location of 100 Seneca St. Oil City, PA (inside work area on 1st floor), on or about May 1st, 2024, and time prior thereto: Employees were potentially exposed to crystalline silica hazards while working around a walk behind cutting saw during concrete cutting operations on the 1st floor area of the facility. Employees were not wearing any form of respiratory protection for this indoor or enclosed area as required in Table 1 of 29 CFR 1926.1153(c)(1)(section 4). ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) a.) Massaro Corporation, worksite location of 100 Seneca St. Oil City, PA (inside work area on 5th floor), on or about May 1st, 2024, and time prior thereto: Employees were required to wear tight-fitting filtering facepiece respirators (Aegis brand N95 TC-84A-5408) during work tasks including, but not limited to, cleaning task with visible dust on the 5th floor of the worksite. One employee was not provided with a medical evaluation prior to the required use of the filtering facepiece respirator. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). Massaro Corporation, worksite location of 100 Seneca St. Oil City, PA (inside work area on 5th floor), on or about May 1st, 2024, and time prior thereto: Employees were required to wear tight-fitting filtering facepiece respirators (Aegis brand N95 TC-84A-5408) during work tasks including, but not limited to, cleaning task with visible dust on the 5th floor of the worksite. An employee was not provided with a fit test prior to the required use of the tight fitting filtering facepiece respirator at the worksite.
