29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used.:  (a)Rivas Plastering, LLC. at 1404 East 69th Street, Sioux Falls, SD 57108: On or about and at times prior to April 30, 2024, the exposing employer did not ensure adequate access was provided to allow for safe access/egress involving the Bil-Jax scaffold Model No. TF6-5W-L3 scaffold system on site.  This condition exposed employees to fall hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  (a)Rivas Plastering, LLC. at 1404 East 69th Street, Sioux Falls, SD 57108: On or about and at times prior to April 30, 2024, the employer did not ensure that employees were protected from falls while conducting plaster work from the second level of the Bil-Jax scaffold Model No. TF6-5W-L3 on a commercial property.  This condition exposed employees to fall hazards greater than ten feet.

This condition exposed employees to fall hazards greater than 10 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)Rivas Plastering, LLC. at 1404 East 69th Street, Sioux Falls, SD 57108: On or about and at times prior to April 30, 2024, the exposing employer did not ensure that all employees were properly trained on how to recognize hazards associated with working on and around scaffolding equipment. This condition exposed the employee to not understanding hazards with scaffolding and not being trained.
