29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about 5/2/2024, the employer did not protect employees who were engaged in residential roofing operations 6ft (1.8m) or more above lower levels while at the job site located at 2401 Golden Bear Way in Wentzville, MO. The employees were conducting residential roofing operations that exposed them to the hazard of falling from a height of greater than ten (10) feet.  Lamas General Contractor LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1544702, citation number 1, item number 2 and was affirmed as a final order on 10/7/2021, with respect to a workplace located at 1437 Thatcher in St. Louis, MO.

29 CFR  1926.59:29 CFR 1926.59:  The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200 as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about 5/1/2024, Lamas General Contractor LLC did not develop, implement, and maintain at each workplace, a written communication program which at least described how the criteria in paragraphs (f) for labels and other forms of warning, (g) for safety data sheets (SDSs), and (h) for employee information and training would be met. Employees were exposed to health and chemical hazards from utilizing gas to power air compressors for the use of pneumatic nail guns at a worksite located at 2401 Golden Bear Way in Wentzville, Missouri.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.   On or about 5/2/2024, the employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record each employee who were engaged in residential roofing operations 6ft (1.8m) or more above lower levels. The employees were not trained in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury while at the job site located at 2401 Golden Bear Way in Wentzville, MO. The employees were conducting residential roofing operations that exposed them to the hazard of falling from a height of greater than ten (10) feet.
