29 CFR 1910.1025(e)(1)(i): For any employees exposed to lead above the permissible exposure limit for more than 30 days per year where engineering and work practice controls (including administrative controls) were feasible but did not reduce the employees' exposure to or below the permissible exposure limit the employer did not use engineering and/or work practice controls to reduce exposures to the lowest feasible level:  At a worksite located at 4722 Pear Street, St. Joseph, MO:   Employees were exposed to toxic lead. Exposure concentrations were greater than the OSHA Permissible Exposure Limit (PEL) of fifty micrograms per cubic meter (50 ug/m3) of air averaged over an eight-hour period for more than 30 days per year. The employer failed to provide engineering and work practice controls that effectively reduced and maintained employee exposure below the OSHA PEL. This was most recently demonstrated on or about June 17, 2024, an employee in COS was exposed to airborne lead at a level of 140 micrograms of lead per cubic meter (ug/m3) of air as an eight-hour time-weighted average (8-hour TWA) for a monitoring period of approximately 461 minutes. The remaining un-sampled period of 19 minutes is assumed to have zero exposure.

29 CFR  1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  At a worksite located at 4722 Pear Street, St. Joseph, MO:   Employees were exposed toxic or hazardous substances. This occurred on or about May 2, 2024, and at times prior to when employees were working in COS lines with secondar spray containers without proper or legible label. This included but was not limited to the use of S2 solvent and RP-754. The employer failed to ensure that all container labels or other forms of warnings were legible, in English, and prominently displayed on the container.  a) COS line #14 a secondary container spray bottle was labeled RP-754, but actually contained S2 Solvent.  b) COS line #15 a secondary container spray bottle was not labeled, but actually contained S2 Solvent.  c) COS line #16 a secondary container spray bottle was labeled RP-754, but actually contained S2 Solvent.  The employer Clarios was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(f)(6)(ii), which was contained in OSHA inspection number 1629201, citation number 1, item number 1 and was affirmed as a final order on April 17, 2023, with respect to a workplace located at 10300 Industrial Rd. Holland, OH 43528.
