29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about May 2, 2024, the employer failed to ensure that frequent and regular inspections of the jobsite were completed by a competent person, exposing employees to fall hazards greater than 14 feet to the lower level in that floor openings were not marked or secured with a cover.

29 CFR 1926.502(i)(3): All covers shall be secured when installed so as to prevent accidental displacement by the wind, equipment, or employees. a) On or about May 2, 2024, the employer failed to ensure that the floor openings, located in the rooftop, were covered and secured to prevent displacement. As a result, an employee fell approximately 14 feet to the lower level after removing an unsecured pallet.

29 CFR 1926.502(i)(4): All covers shall be color coded or they shall be marked with the word "HOLE" or "COVER" to provide warning of the hazard. Note: This provision does not apply to cast iron manhole covers or steel grates used on streets or roadways. a) On or about May 2, 2024, the employer did not ensure that floor hole coverings were marked as such to provide warning to the employees of the hazard. As a result, an employee removed an unmarked wood pallet and fell approximately 14 feet to the lower level.
