29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  A worker was observed standing on an improvised work platform of plywood sheets that were strapped to the forks of a JLG Sky Trak 8042 Telehandler while he was sheathing a chimney without fall protection approximately four-stories above ground level.  Violation was observed on or about May 2, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  A worker was using a makeshift scaffold supported by a JLG SkyTrak 8042 Telehandler to sheath the chimney of an approximately four story multi-family residential building  with no fall protection in place. The makeshift scaffold was only secured by two nylon straps that stretched  from fork to fork. The makeshift scaffold was not secured to the mast. The worker was not properly trained in scaffolding to recognize these hazards.  Violation occurred on or about May 2, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  A worker was observed installing sheathing while standing on the roof of a four story multi-family residential building with the use of fall protection on. The employee was exposed to fall hazards of approximately thirty feet to ground.  Violation was observed on or about May 2, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   a) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  The JLG SkyTrak 8042 Telehandler being used to perform work on site had its right front tire worn beyond limits with visible threads showing.   Violation was observed on or about May 2, 2024.  b) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  The JLG SkyTrak 8042 Telehandler operator did not perform a Pre-Operation Inspection on the machine before running it. The SkyTrak Legacy Series Owner's / Operator's Manual includes within its Operation section, a Pre-Operation Checklist that includes seven items to be checked before operating the vehicle.  Violation was observed on or about May 2, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:   a) Worksite was located at 102 2nd Avenue, Belmar, NJ 07719:  A worker was observed being raised while standing on an improvised work platform of plywood sheets that were strapped to the forks of a JLG Sky Trak 8042 Telehandler. The worker was sheathing a chimney without fall protection approximately four-stories above ground level. The machine operator had to back the machine away from the building in order to boom down.  Violation was observed on or about May 2, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
