29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about 5/3/2024, and times prior thereto, employees conducted crane lift operations of metal sheet pilings and the rigging employee was not protected by protective helmets while working under the crane hook and rigging equipment where there was a possibility of head injury from impact.

29 CFR 1926.1427(a): The employer must ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section. On or about 5/3/2024, and times prior thereto, the employer conducted crane lifting operations of metal sheet pilings and the crane operator was not certified/licensed and evaluated before operating the RTC-8050 Crane.
