29 CFR 1910.147(c)(6): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  The periodic inspection must: [A] be performed by an authorized employee other than the ones utilizing the energy control procedure being inspected.   [B] be conducted to correct any deviations or inadequacies identified. [C] where lockout is used for energy control, include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected. [D] where tag-out is used for energy control, include a review between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.   a. On or about February 12, 2024, employees performing servicing or maintenance on the Cincinnati Model: 2512G Serial No. 48926 mechanical #2 Shear were exposed to hazardous energy when the employer failed to periodically inspect energy control procedures and practices to ensure that the steps in the energy control procedure are followed, the employees involved know their responsibilities under the procedure, the procedure is adequate to provide the necessary protection and what changes, if any, are needed.

29 CFR 1910.147(c)(7)(i)(A): The employer failed to provide adequate training to their authorized employee(s) in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and, and the methods and means necessary for energy isolation and control.  a. #2 Cincinnati Shear - On or about February 12, 2024, the employer failed to provide training to each authorized employee performing service and/or maintenance to machinery or equipment to ensure the employee acquired the knowledge and skills required for the safe application, usage and removal of energy control devices. Machine operators and helpers were exposed to crushing and caught in injuries while performing maintenance on the Cincinnati Model: 2512G Serial No. 48926 Shear to adjust the knife clearance after following a blade change.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedure) was not done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):   a. On or about February 12, 2024, employees were exposed to machine hazards associated with moving parts, in-going nip points, and caught in hazards during servicing and adjusting the knife clearance during a blade change on the #2 Cincinnati Model: 2512G Serial No. 48926 mechanical shear. The employer failed to implement energy control application steps as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements.] As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.147(f)(3)(i): When servicing and/or maintenance is performed by a crew, craft, department or other group, they shall utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device.  a. On or about February 12, 2024, the employer failed to ensure that four employee(s) involved in the servicing and maintenance task of changing a knife blade and adjusting the knife clearance at the Cincinnati Model: 2512G Serial No. 48926 mechanical #2 Shear utilized the established procedure which affords the employees a level or protection provided by the implementation of a personal lockout or tagout device, therefore exposing employees to crushing/pinch-point injuries to their hands and arms.
