29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) 87 Dubois St Staten Island, NY 10310.  Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on concrete steps and sidewalk were exposed to the hazard of crystalline silica inhalation due to the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a STIHL portable power saw to cut concrete sidewalk and block(s) without integrated water delivery system for continuously feeding water to the blade, as designed for use with the tool for dust suppression.   Condition(s) were noted on or about May 9, 2024.

29 CFR  1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) 87 Dubois St Staten Island, NY 10310.  Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on concrete stairs and sidewalk were exposed to the hazard of crystalline silica inhalation due to the employer's failure to fully and properly implement dust control method(s) prescribed for task(s) listed in Table-1 when working on materials containing crystalline silica. Employee(s) used a STIHL portable power saw to cut concrete sidewalk and block(s) without integrated water delivery system for continuously feeding water to the blade, as designed for use with the tool for dust suppression. Where the control measures prescribed in Table-1 were not implemented, the employer did not assess employees' exposure to crystalline silica through air monitoring.   Condition(s) were noted on or about May 9, 2024.

Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on steps and sidewalk(s) were exposed to the hazard of respirable crystalline silica inhalation when the employer failed to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) cut concrete sidewalk and block(s) using a Stihl portable power saw without integrated water delivery system for continuously feeding water to the blade, as designed for use with the tool for dust suppression. A plan for controlling exposure to crystalline silica dust on jobsites was not developed & implemented by the employer.  Condition(s) were noted on or about May 9, 2024.

Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on a concrete steps and sidewalk were exposed to the hazard of respirable crystalline silica inhalation while cutting concrete block and sidewalk using a STIHL portable demo saw without integrated water delivery system for continuously feeding water to the blade, as designed for use with the tool for dust suppression. At the time exposed employee(s) could not demonstrate knowledge and understanding with the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; the identity of the competent person designated by the employer in accordance with paragraph (g)(4) of this section.  Condition(s) were noted on or about May 9, 2024.
