29 CFR  1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about , the employer did not ensure that frequent and regular inspections were being conducted by a designated competent person for the jobsite at 7555 Fields Ertel Rd, Cincinnati, Ohio 45241. As a result, employees performing roofing activities were exposed to a fall hazard of 9'8" from a lack of conventional fall protection and ladder not extended 3 feet above the upper landing surface.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a)On or about 05/07/2024, the employer did not ensure that the ladders being utilized by employees to access the roof to apply tar paper on the roof to protect against incoming inclement weather was extended 3 feet above the upper landing surface. As a result, employees were exposed to a fall hazard of 9'8" accessing and exiting the roof.

29 CFR  1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On or about 05/07/2024, the employer did not ensure that an employee was utilizing a fall protection system while placing tar paper on a roof of a gas station being renovated in order to protect the roof from incoming rain, employee was exposed to fall heights of at least 9'8".

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about 05/07/2024, the employer did not ensure  that an employee was trained in the recognition and avoidance of fall hazards in that they were on the roof of a commercial structure while not utilizing conventional fall protections systems and did not have a ladder extended three feet above the upper landing surface, exposing the employee to a fall hazard of 9'8".
