Employee(s) used an Evolution 12-inch electric concrete saw without integrated water delivery system for continuously feeding water to the blade while cutting concrete floor surfaces. 29 CFR  1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) 910 Highway 1. Edison, NJ 08817   Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on a concrete floor were exposed to the hazard of crystalline silica inhalation due to the employer's failure to implement engineering controls prescribed in Table-1 for dust control, or alternatively, assess airborne exposure(s) during use dust control means other than those prescribed in Table-1. Employee(s) used an Evolution 12-inch electric concrete saw without integrated water delivery system for continuously feeding water to the blade,  as designed for use with the tool for dust suppression. Concrete floor(s) were chipped / broken up using a Hex breaker (Bosch) jackhammer without attaching a shroud and dust collection system.       Condition(s) were noted on or about May 10, 2024.

Edison, NJ 08817   Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on concrete slab were exposed to the hazard of respirable crystalline silica inhalation when the employer failed to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) cut concrete floor(s) indoors using an Evolution 12-inch electric concrete saw without integrated water delivery system for continuously feeding water to the blade,  as designed for use with the tool for dust suppression. Concrete floor(s) were chipped / broken up using a Hex breaker (Bosch) jackhammer without attaching a shroud and dust collection system.  A plan for controlling exposure to crystalline silica dust on jobsites was not developed & implemented by the employer.  Condition(s) noted on or about May 10, 2024.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) 910 Hwy 1 Edison, NJ 08817   Employee(s) donned negative pressure half-face respirators while cutting and chipping concrete floor(s) inside an auto dealership building using a handheld concrete saw (Evolution R300DCT 12-inch concrete saw) and a chipping tool (Bosch Brute Jackhammer) without information and guidance from the employer to be sure the respirator itself does not present a hazard, such that would ensure the employee(s) were medically able to use that respirator, and that the respirator is clean, stored, and maintained so that its use does not present a health hazard to the users.  Condition(s) were noted on or about May 10, 2024.
