29 CFR 1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck. a) On or about May 14th, 2024 Cutting Edge Lawn and Landscape, Inc. failed to ensure that each powered industrial truck operator successfully completed the training and evaluation, specified by 1910.178(l) prior to permitting employee(s) to operate powered industrial trucks (Bobcat Compact Skid Steer Track Loader Model #ALJG12250, with fork attachments). Failure to provide the required training and evaluation to PIV operators will expose the operator, as well as others working in and around forklift operating areas to struck-by injuries, tipping, and rollover incidents.
