29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles.   On or about May 14th, 2024 KF Construction and Excavating, LLC  at the jobsite located at Sunset Lane Lot #5 Fremont, Ohio 43420, did not ensure that each affected employee used appropriate eye or face protection when performing  cutting activities, exposing employees to potential struck by hazards (flying particles/debris) while using the STIHL TS 420 chop saw.

29 CFR  1926.651(j)(1):Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection.  On or about May 14th, 2024 KF Construction and Excavating, LLC  at the jobsite located at Sunset Lane Lot #5 Fremont, Ohio 43420, did not ensure  that employees were adequately protected from loose rock or soil (spoils pile) from falling or rolling at the excavation face.
