29 CFR 1910.147(c)(1):  Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  At an establishment located at 2809 North Conkey Street, in Appleton, Wisconsin:  (a)  The employer failed to develop and document a Hazardous Energy Control Program to include energy control procedures when employees were performing servicing and maintenance activities.  (b)  The employer failed to develop and document a Hazardous Energy Control Program to include employee training when employees were performing servicing and maintenance activities.  (c)  The employer failed to develop and document a Hazardous Energy Control Program to include periodic inspections when employees were performing servicing and maintenance activities.

29 CFR 1910.217(b)(6)(i): A two-hand trip shall have the individual operator's hand controls protected against unintentional operation and have the individual operator's hand controls arranged by design and construction and/or separation to require the use of both hands to trip the press and use a control arrangement requiring concurrent operation of the individual operator's hand controls.  On or about May 7, 2024, at an establishment located at 2809 North Conkey Street, in Appleton, Wisconsin; the two-hand trip used to activate the Walsh Press & Die Company 40 Ton full revolution press was not arranged to protect against unintentional operation in that the controls were located approximately 17 inches apart, did not operate concurrently, and the right trip button was not protected by shroud.

29 CFR 1910.217(c)(3)(viii)(c):  The safety distance (D(m)) between the two-hand trip and the point of operation shall be greater than the distance determined by the following formula:  D(m) = 63 inches/second X T(m);  where:  D(m) = minimum safety distance (inches); 63 inches/second=hand speed constant; and  T(m) = the maximum time the press takes for the die closure after it has been tripped (seconds). For full revolution clutch presses with only one engaging point T(m) is equal to the time necessary for one and one-half revolutions of the crankshaft. For full revolution clutch presses with more than one engaging point, T(m) shall be calculated as follows:  T(m) = [1/2 + (1 divided by Number of engaging points per revolution)] X time necessary to complete one revolution of the crankshaft (seconds).  On or about May 7, 2024, at an establishment located at 2809 North Conkey Street, in Appleton, Wisconsin; the Walsh Press & Die Comp 40 Ton Full Revolution Press #8 did not have a safe distance between the two-hand trip and point of operation exposing employees to caught between hazards.

29 CFR 1910.217(e)(1)(i):  It shall be the responsibility of the employer to establish and follow a program of periodic and regular inspections of his power presses to ensure that all their parts, auxiliary equipment, and safeguards are in a safe operating condition and adjustment. The employer shall maintain a certification record of inspections which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the power press that was inspected.  On or about May 7, 2024, at an establishment located at 2809 North Conkey Street, in Appleton, Wisconsin;  the employer did not develop, implement and certify a program for periodic and regular inspection of mechanical power presses, including but not limited to Walsh Press & Die Company 40 Ton full revolution press to ensure that all of its parts, auxiliary equipment, and safeguards, including the clutch/brake mechanism, anti-repeat feature, and single-stroke mechanism, are in a safe operating condition.  This exposed employees to crushing and amputation hazards.

Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes. 29 CFR 1910.243(b)(2):  Air hose. Hose and hose connections used for conducting compressed air to utilization equipment shall be designed for the pressure and service to which they are subjected.  On or about May 7, 2024, at an establishment located at 2809 North Conkey Street, in Appleton, Wisconsin, the air hose used in part to supply air to the single-stroke mechanism on the Walsh Press & Die Comp Full Revolution Press #8 was attached to the hose fitting by a worm drive type hose clamp which was not designed for use on an air hose, thereby exposing the employees to the whipping action of the hose if the clamp were to come off.
