OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to laceration hazards due to employees using grinders one handed and without the aid of the auxiliary handle.  Location: 150 Gleneagle Drive, Mashpee MA Backyard area  On or about May 15, 2024, employees were exposed to serious bodily injury while using a grinder without a side handle as described by ANSI B7.1 2010 as well as the procedures outlined in the operator's manual.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  Location: 150 Gleneagle Drive, Mashpee MA Backyard area  On or about May 15, 2024, employees were exposed to health hazards associated to respirable crystalline silica by not implementing engineering controls outlined in Table 1 of this OSHA standard.  Employees were required to cut and grind veneer stone, the employer did not fully implement the required engineering controls, work practices, and respiratory protection specified for the task of "Handheld grinders for uses other than mortar removal" as outlined on Table 1, "Equipment/task (xii)" outlined in 29 CFR 1926.1153.  Employees were exposed to respirable crystalline silica while using a grinder not equipped with a dust collection system to manage dust control. These controls are required because the employer did not conduct an employee exposure assessment in accordance with paragraph (d) of this section to determine if workers were overexposed to crystalline silica.

29 CFR  1926.1153(e)(1):Where respiratory protection was required by this section, the employer did not provide each employee an appropriate respirator that complied with the requirements of this paragraph and 29 CFR 1910.134:  Location: 150 Gleneagle Drive, Mashpee MA Backyard area  On or about May 15, 2024, workers were required to cut and grind veneer stone.  When the employer did not use adequate measures to control the silica-containing dust, not all employees were provided with an appropriate respirator that complied with the requirements of 29 CFR 1910.134.  Worker wore a disposable dust mask that was not effective against silica-containing dusts above the PEL.
