29 CFR 1910.1200(e)(2)(ii): The employer's hazard communication program did not include methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operations and in foreseeable emergencies: On or about May 15, 2024, at 8679 South Freeway Drive, Macedonia, OH 44056, the employer failed to ensure that their hazard communication program was developed and implemented including methods used to inform employees of other employers of any precautionary measures that need to be taken to protect employees during the workplace's normal operating conditions and in foreseeable emergencies. The employer did not ensure that employees were aware of possible chemical reaction between chemicals including but not limited to Cerfa-Kleen L561 and the tank into which it is loaded.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: On or about May 15, 2024, at 8679 South Freeway Drive, Macedonia, OH 44056, the employer failed to ensure that employees filling tanker trucks were protected from explosion/chemical burn hazards in that employees were not trained on the physical hazards associated with corrosive liquid chemicals including but not limited to Cerfa-Kleen L-561 such as the ability to react with aluminum to generate hydrogen gas.
