29 CFR  1903.19(c)(1):The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated.  (a) ECLIPSE ROOFING LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1 item 1 serious violation of 29 CFR 1926.20(b)(2) with an abatement date of September 11, 2024.  Citation 1 item 2 serious violation of 29 CFR 1926.102(a)(1) with an abatement date of September 5, 2024.  Citation 1 item 3 serious violation of 29 CFR 1926.503(a)(1) with an abatement date of September 25, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about May 16, 2024 at the jobsite located at 3053 W Drexel Ave, Franklin, WI 53132, the employer who was the competent person did not ensure that frequent and regular inspections of the job site were conducted to identify hazards, and the job sites were maintained safe.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about May 16, 2024, at the jobsite located at 3053 W Drexel Ave., Franklin, WI 53132 the employer did not provide fall protection training to enable workers to recognize and control the fall hazards at their worksite while performing residential construction.  The workers were exposed to a fall hazard of up to 20 feet.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  (a) On or about May 16, 2024, at the jobsite located at 3053 W Drexel Ave., Franklin, WI 53132 the employer did not ensure employees on the roof of the structure engaged in re-roofing of a residential apartment complex were protected from fall hazards. This exposed employees to a fall hazard of approximately 20 feet from the roof to the ground below.  Eclipse Roofing LLC was previously cited for a violation of this occupational safety and health standard CFR 1926.501(B)(13), which was contained in OSHA inspection number 1711477, citation number 1, item number 1 and was affirmed as a final order on March 4, 2024, with respect to a workplace located at 831 Dakota Dr, Hartford, WI 53027.
