29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. On or about May 14th, 2024, Arismendez Construction LLC failed to instruct employees at or near Blue Beauty 15-22 Tank Battery, Lamesa TX 79331 in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injury, in that lifting straps were placed around the forks of a rough terrain telehandler. This practice is not recommended and or approved by the manufacturer of the telehandler due to the potential of the lifting strap sliding off the forks.

On or about May 14th, 2024, Arismendez Construction LLC at or near Blue Beauty 15-22 Tank Battery, Lamesa TX 79331 did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation when using a powered industrial truck to lift a vent pipe assembly.
