29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) At 19815 County Road 12 S, Wyld Palms Amenity, Foley, Alabama: On or about May 16, 2024 and at times prior; the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injuries. Employees were working in a twelve foot deep trench without any safety training regarding trenching and excavation work.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) At 19815 County Road 12 S, Wyld Palms Amenity, Foley, Alabama: On or about May 16, 2024 and at times prior; the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring 12 feet deep, 5 feet wide, and 95 feet in length that was dug in class "B" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was not sloped at an angle steeper than one and one-half horizontal to one vertical.
