29 CFR  1910.23(b)(9): 29 CFR 1910.23(b)(9): The employer did not ensure that ladders  are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury.   a) Facility, 48-50 Washington Street, Paterson, NJ 07501:  An employee was exposed to a fall hazard while standing on the top step of a three-foot A-Frame step ladder with a broken spreader while removing dough from the machine, on or about 5/13/2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 PURSUANT TO 29 CFR 1903.19.

29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   a) 48-50 Washington Street/Rear Exit Door: The employees using the designated rear exit door were exposed to a fall hazard of approximately 4 foot 8 inches from a loading dock, on or about May 13, 2024.

This condition would prevent employee's from exiting the building in the event of an emergency, on or about May 13, 2024.

29 CFR  1910.263(k)(9):  Dough hoppers shall have the entire opening protected with substantial grid-type guards to prevent the employee from getting his hands caught in moving parts, or the hopper shall be extended high enough so that the operator's hands cannot get into moving parts.   a) Facility, 48-50 Washington Street - Dough Divider: An employee was exposed to an amputation hazard from the rotating parts of the Adamatic dough machine while using his hand to push the dough down, on or about May 13, 2024.  b) Facility,  48-50 Washington Street - Dough Divider:  An employee was exposed to an amputation hazard from the rotating parts of the Adamatic dough machine while using his hand to push the dough down, on or about May 30, 2024.    Valenti's Bakery LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.212(a)(1), which was contained in OSHA inspection number 1676444, citation number 1, item number 2 and was affirmed as a final order on 4/26/2024, with respect to a workplace located at 48-50 Washington Street, Paterson, NJ 07501.
