29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a) On May 21, 2024, at a trench located at the corner of Knudsen Ave. & Minnesota Dr. Bismarck, ND, safe access to a ladder was not provided for the employee operating a packer in a trench greater than 4 feet in depth, the ladder was not placed in the bottom of the trench where the employee was working.

(a) On May 21, 2024, at a trench located at the corner of Knudsen Ave. & Minnesota Dr. Bismarck, ND, employees were exposed to overhead struck-by hazards when working in a trench installing a water line where the spoil pile was not set back two feet.
