Located at the job site at 5189 Clark State Rd, Gahanna, Ohio: On or about May 21, 2024, and at times prior, Kleen Sweep Chimney Service, LLC did not ensure that programs were initiated and maintained on-site including, but not limited to, scaffold safety, tool safety, respiratory protection, fall protection/prevention, hazard communication, heat stress, personal protective equipment, ladder safety, etc. As a result, workers were exposed to fall, inhalation, and struck-by hazards while performing masonry contracting work.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a.  Located at the job site at 5189 Clark State Rd, Gahanna, Ohio: On or about May 21, 2024, Kleen Sweep Chimney Service, LLC. did not ensure that the 20-foot aluminum portable extension ladder utilized to access the roof was extended at least 3 feet above the upper landing surface. Located at the job site at 5189 Clark State Rd, Gahanna, Ohio: On or about May 21, 2024, and at times prior, the employer did not implement the controls listed on Table 1 for employees exposed to respirable crystalline silica while performing tasks such as, but not limited to, grinding out mortar joints (tuckpointing) the joints of the existing chimneys. As a result, employees were exposed to inhalation hazards.

Located at the job site at 5189 Clark State Rd, Gahanna, Ohio: On or about May 21, 2024, and at times prior, Kleen Sweep Chimney Service, LLC did not ensure that employees performing masonry construction and demolition work were trained on the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used; the contents of this section; the identity of the competent person designated by the employer in accordance with paragraph (g)(4) of this section; and the purpose and a description of the medical surveillance program required by paragraph (h) of this section. As a result, workers were exposed to inhalation hazards and the resulting health impacts of exposure to respirable crystalline silica while performing masonry construction and demolition work tasks including, but not limited to, tuckpointing, chimney repairs with saws, and chimney demolition.
